This research will detect and determine the influence of English contract law on the contract law in China basing on the combination of qualitative and quantitative data analysis methods on the secondary resource collections.
Along with the rapid development of modern society, the internalization process is become increasingly urgent and the globalization has become the most significant trend in the every field in the whole world. Such a significant development trend in the whole world has not only facilitated the international business, but also facilitated the interaction and communication of people among different countries with different cultures (Orbuch and Singer, 1995). Also, such internationalization and globalization has facilitated the interaction of different laws in global business context, especially, the frequent occurrence of the international cooperation has promoted the interaction of the contract law. Under the increasingly development of global business environment, the different laws are also interacted and influenced during the business process (Hill, 2008).
China as the biggest developing country in the world has suffered huge changes and influences from the other countries in the world, depending on the efficiency development and expansion of international business, the foreign factors have played significant effect in the development process. And along with the rapid development of the global economy, especially under the rapid formulation and promotion of the economic globalization, the devise of the contract laws have gradually become the blocks for the economic development of every country even for the economic development of the whole world. Under this situation, the current international uniform contract laws have become the gradually significant trend in global context; different countries start to change and amend their contract laws towards the international uniform contract laws thus to avoid the differences and in order to facilitate the economic development and promote the globalization and internationalization of the globalization economy. And the existing international uniform contract law has promote the national economy and even the role of world economic development, this function is increasingly been strengthened and international uniform contract law is also increasingly active role in this world be aware of. Therefore, countries have joined the international harmonization of contract law movements; China is no exception, has also timely made some adjustments and reforms on the contract thus to adapt to the new situation in the world economy.
The English contract law as the law which plays the most significant role in the international uniform contract laws will obviously play a significant role in the formulation and uniform of contract laws in China. Especially under the frequent contact and communication, influence and interaction in the interaction business between China and the UK, the English contract law will not only influence the formulation and change of the contract in China through the international uniform contract law way but will also impact the change of the contract law in China through the daily communication, interaction and effecting in the international business and cooperation. And the current contract law in China has already emerged the situation that some are same to the English contract and others have been influenced by the English contract law. For instance, the English contract law has influenced the structure of contract law in China, and also impact on the details list of the contract law in China, such as the limitations and requirements, there are many points in the China contact law same as the English contract law. Furthermore, the contract law in China should more learn from the English contract law especially on its implementation capacity and the coverage of the law, as well as the new list in the English contract law which raised in contemporary business should also be learnt by the contract law in China since the English contract law has the long period experience and practice than Chinese. Therefore, due to these significant reasons, this dissertation will detect the details influence of the English contract on the contract law in China. To detect how the influences have done and what are the details influences of the English contract law on the formulation and changing of the contract law in China could help the fellow scholars to better understand the contract laws in China and also help the international business men to better doing their business in China by the understanding of the similarities of the contract law in China and the UK. It could also contribute to the enrichment of the literatures related to the development and formulation of the contract law in China and the impact of the internationalization and
